MITA Appeals Policy
Last updated: April 2026
This policy applies to our customers, including learners and MITA-approved training centres (“centres”), who are delivering, enrolled on, or have taken an approved qualification or unit. It explains how to submit an appeal and how we will handle it.
It also supports our staff in managing appeals consistently and fairly.
Scope
This policy covers:- Appeals relating to assessment decisions where procedures may not have been followed consistently, properly, or fairly
- Appeals about centre approval decisions
- Appeals concerning monitoring reports
- Appeals relating to reasonable adjustments or special consideration decisions
- Appeals relating to sanctions following verification visits or investigations into malpractice or maladministration, including changes to learner results
- Appeals following the outcome of a complaint about a centre
Centre responsibilities
Centres must ensure relevant staff and learners are aware of this policy. Centres must have an internal appeals process. Learners are expected to complete this before appealing to MITA.Review arrangements
We review this policy annually and update it as needed in response to feedback or regulatory guidance, for example from Ofqual.Fees
We do not charge for handling appeals.Raising an appeal
Appeals must be submitted within 20 working days of the decision. Centres should ensure learners retain relevant evidence until results are confirmed. If appealing on behalf of a learner, centres must have written consent, as results may go up or down. Learners should normally appeal through their centre first and complete the centre’s internal process before contacting MITA. Direct appeals are only accepted in exceptional cases, with evidence provided. Appeals must be submitted via the MITA online system (“The Engine”) with supporting information, including:- Learner name and registration number
- Date(s) of the decision
- Qualification details, if applicable
- Full details of the appeal
- Outcome of any internal investigation
Regulatory considerations
If regulators identify issues in other organisations, we will review our own processes to ensure similar risks are addressed.Initial review
We will acknowledge appeals within 48 hours and aim to complete an initial review within 20 working days. This may take longer if required, for example for a centre visit. Reviews are carried out by trained personnel with no prior involvement. Following review, we will either:- amend the decision based on new evidence, or
- confirm the original decision with reasons
Independent review
If escalated, an independent reviewer with no connection to MITA will assess whether procedures were applied fairly and consistently. This may involve discussions, further evidence requests, or a centre visit. The decision is final. Outcomes will be issued within 20 working days. If still dissatisfied, the matter can be raised with the relevant regulator, for example Ofqual.Outcomes and improvements
Where appeals are upheld or issues identified, we will take appropriate action. This may include:- Updating centre records in “The Engine”
- Correcting or mitigating impacts on learners
- Improving our processes to prevent recurrence
